Court grants a request to revoke the detention

A court has granted a request to revoke the detention of President Yoon Suk Yeol, who was indicted and detained on charges of being the "ringleader of a rebellion" related to the martial law crisis.

 

The Seoul Central District Court's Criminal Division 25 (Head Judge Ji Gui-yeon) granted Yoon's request to cancel his detention on March 7.

 

 

Revocation of detention is a system that allows prosecutors, defendants, defense lawyers, and others to ask the court to remove a person from detention when the reason for detention no longer exists or has been eliminated.

 

President Yoon’s lawyers had requested his release from custody on March 4, alleging the illegality of his detention.

 

During the hearing, Yoon's defense lawyers argued that his detention was illegal because his detention period was set to expire on January 25, but the prosecution indicted him a day later.

 

The prosecution countered that the charges were filed before the statutory period of detention had expired, excluding the period for the review of the arrest and the substantive review of the warrant.
